1. About us and these terms

This website is operated by KT Air Limited, a company registered in England and Wales under company number 15824220, whose registered office is at Unit 30, Mountney Bridge Business Park, Westham, Pevensey, East Sussex, BN24 5NH.

These terms apply to your use of this website and to every contract for the sale of goods between us. Please read them before placing an order. By opening an account or placing an order you confirm that you accept them.

These terms and any order acknowledgement we issue form the entire agreement between us. They apply to the exclusion of any terms you seek to impose, including any printed on your purchase order, unless we have agreed otherwise in writing.

2. Who these terms apply to

We sell to the trade and to private customers alike. These terms apply to both, but not every part applies to everyone.

If you are buying for a business, meaning for purposes relating to your trade, business, craft or profession, the whole of these terms applies to you, including the limits on our liability in section 13.

If you are buying as a private customer, you have rights under the Consumer Rights Act 2015 and, where you order online rather than at the counter, the Consumer Contracts Regulations 2013. Nothing in these terms takes those rights away. Where anything here conflicts with them, your statutory rights win. Sections 10 and 13 set out how returns and liability differ for you.

3. Accounts

An account is free and exists so that you can see your pricing and place orders for collection. You are welcome to buy at the counter without one.

Accounts are subject to approval. We may decline an application, or withdraw an account, without giving reasons.
The information you give us must be accurate, and you must tell us if it changes, in particular your contact number, since that is how we reach you when an order is ready.
You are responsible for keeping your login details confidential and for all orders placed using them. Tell us immediately if you believe someone else has access.
We may suspend or close an account where these terms have been breached or where we reasonably suspect fraudulent use.

4. Using this website

You may use this website for lawful purposes. You must not misuse it, for example by introducing malicious code, attempting to gain unauthorised access to it or to any server or database behind it, or extracting data from it systematically for use elsewhere.

We may suspend, withdraw or change any part of the site without notice. We do not guarantee that the site or its content will always be available or uninterrupted.

5. Products and descriptions

Product images, dimensions, weights and performance figures are provided by manufacturers and are for guidance. Minor variations may occur, and manufacturers may change specifications without notice. It is your responsibility to satisfy yourself that a product is suitable for the application before ordering, and to install it in accordance with the manufacturer's instructions and applicable regulations.

Certain products, including refrigerants and equipment containing fluorinated greenhouse gases, may only be supplied to appropriately qualified or certified purchasers. We may ask for evidence of certification before accepting an order.

6. Prices

Prices shown to account holders are trade prices and exclude VAT unless stated. Prices shown to private customers include VAT.
Prices are those in force at the time we accept your order. We may change prices at any time before acceptance.
We take care to price accurately, but if a product is listed at an obviously incorrect price we are not obliged to supply at that price. We will contact you before proceeding.

7. Orders and collection

Your order is an offer to buy. A contract is formed only when we confirm that the order is ready to collect. An acknowledgement that we have received the order is not an acceptance.

Once you have ordered we pick the goods and contact you, normally by telephone, to tell you they are ready. Orders placed before our afternoon cut-off are usually ready the same working day, but that is an estimate and not a guarantee.

Goods are held at the counter for seven days from the day we tell you they are ready. After that we may return them to stock and cancel the order.
Stock figures shown on the site are a guide and are not a guarantee of availability. If we cannot supply an item we will tell you and offer an alternative or a revised lead time.
Please check the goods before you leave the counter. Shortages, incorrect items or visible damage are far easier to put right there and then.
We may ask for proof of identity, or that you are the account holder, before releasing an order.

8. Payment

Payment is due in full when you collect. We do not offer credit accounts.
We accept the payment methods displayed at the counter at the time of collection.
Goods remain ours until they are paid for in full.

9. Risk

Risk in the goods passes to you when you take them from the counter. From that point they are your responsibility, including loading and transporting them safely.

10. Cancellations, returns and refunds

Everyone

You may cancel an order at no charge at any point before you collect it. Just let us know so we can put the goods back on the shelf.
Unwanted goods may be returned to the counter within 28 days of collection provided they are unused, complete and in their original undamaged packaging. Bring your receipt.
A restocking charge of up to 10% may be applied to unwanted returns.
Special order, bespoke, cut-to-length and made-to-order items cannot be returned unless faulty.

Private customers: your additional right to cancel

Because an order placed on this website is agreed at a distance, private customers have a legal right to cancel it under the Consumer Contracts Regulations 2013. This is on top of the 28 day policy above, and no restocking charge applies to it.

You have 14 days from the day you collect the goods to tell us you are cancelling. You then have a further 14 days to return them.
You do not have to give a reason, and the goods do not have to be unopened, though you are responsible for any loss in value caused by handling them more than you would in a shop.
We refund within 14 days of getting the goods back.
This right does not apply to goods made or cut to your specification, and it does not apply if you bought at the counter rather than ordering online, since that is not a distance sale.

11. Faulty goods and warranties

Goods are supplied with the benefit of the manufacturer's warranty, and we will pass on and support any claim under it. If goods are faulty, tell us within a reasonable time of discovering the fault and we will arrange a repair, replacement or refund.

Warranties do not cover fair wear and tear, damage caused by misuse or accident, failure to follow the manufacturer's instructions, incorrect installation, inadequate maintenance, or modification of the product.

12. Intellectual property

All content on this website, including text, images, layout, logos and the KT Air name, is owned by us or licensed to us and is protected by intellectual property law. You may view and print pages for the purposes of your business dealings with us. You may not otherwise copy, republish or use our content without our written permission. Manufacturer brand names and trade marks remain the property of their owners.

13. Our liability

Nothing in these terms limits or excludes our liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation;
any other liability that cannot lawfully be limited or excluded.

Subject to that, and only where you are buying for a business:

we are not liable for loss of profit, loss of business, loss of contracts, loss of anticipated savings, site delay or disruption costs, or any indirect or consequential loss;
our total liability in connection with any contract is limited to the price paid for the goods giving rise to the claim;
we are not liable for the cost of removing or reinstalling goods, or for making good surrounding works.

If you are a private customer, those limits do not apply to you. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, or for any loss connected with using a product for a business purpose.

14. Events outside our control

We are not liable for any failure or delay caused by something outside our reasonable control, including supplier or manufacturer failure, transport or carrier disruption, industrial action, extreme weather, fire, flood, or the failure of utilities or telecommunications networks. If such an event occurs we will contact you and the time for performance will be extended.

15. Data protection

We handle personal information in line with our privacy policy, which explains what we collect, how we use it and what rights you have.

16. Changes to these terms

We may amend these terms from time to time. The version in force when you place an order is the version that applies to that order, so please check this page before ordering.

17. General

We may transfer our rights and obligations under a contract to another organisation. You may not transfer yours without our written consent.
A contract is between you and us. No other person has any right to enforce its terms.
If any provision is found to be unlawful or unenforceable, the remaining provisions continue in force.
A delay in enforcing any term is not a waiver of it.

18. Governing law and jurisdiction

These terms and any contract between us are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.
